The Terms and Conditions for use of the Media Lightbox website are detailed below and should be read carefully.  These terms and conditions and your use of our web site are governed by Northern Ireland Law and you agree to submit to the non-exclusive jurisdiction of the Northern Ireland court.  This does not affect your non-excludable statutory rights.

Purchases

The basic steps required when placing an order are as follows:
1    You will be guided through the process of placing an order by a series of simple instructions on the website. You place the order for your products on the website by pressing the confirm order button at the end of the check-out process.
2    You will receive an order acknowledgement email detailing the products or services you have ordered. The email will be sent to the email address which you enter on the confirmation screen.  If you supply an incorrect email address, you will not receive an acknowledgment.

We will take reasonable care to keep details of your order and payment details secure but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

Payment

• Media Lightbox use Realexpayments as a secure method of on-line payment.
• All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of publishing.
• We accept online payment in a secure environment by Credit / Debit card. We accept all major credit and debit cards with the exception of American Express.
• We do not accept payment by cheque or cash.
• When confirming your order, only the last four digits from your credit card will be revealed.
• The entire credit card number will only be transmitted to the appropriate credit card company during order processing.
• Media Lightbox takes responsibility for online transactions.

Cancellation Right

If you sign up for the trial - you have 30 days in which to assess the Media Lightbox product and see how it can work for your company and help you save time and money.  You can cancel your trial anytime within the 30 day period by emailing  Cancel Trial and requesting that your trial is cancelled.

Your free trial period will end at midnight, 30 days after initial signup. If you don't want to continue using Media Lightbox, just cancel before the trial ends and you won't be charged. Otherwise, you'll pay the normal fee for the service as long as your account is open.

In order to cancel, you MUST do this via your system administration OR by email request.  To cancel, simply:

1. Click on the 'UPGRADE' tab
2. Click on the 'Cancel' link (within the 'Account Details' section
   

At any time, you can Upgrade, downgrade or Cancel your account.

Returns and Refunds Policy

Media Lightbox offer our service as a monthly subscription, payable at the end of each month. Users may cancel their subscription at any time without notice. In general refunds are not available for any past subscriptions.

Errors and Omissions

We make every effort to ensure that the information that is published on this website is accurate and up to date. However, the pictures and documents published on the site may contain typographical errors or technical inaccuracies. If a price error is made and a product is listed at an incorrect price, we maintain the right to refuse, cancel or refund any orders placed.

Ownership of Rights

All rights including copyright, in this website are owned by or licensed to Media Lightbox. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use is prohibited without the written consent of Media Lightbox. You may not modify, distribute or re-post anything on this website for any purpose. 

We will remove all data from Free accounts that have been inactive for more than 90 Days

Inappropriate Content

Media Lightbox do NOT review content from users as a rule, however,  If it is brought to our attention that content could be considered as containing profanity, violence, pornography, prejudicial content, lewd content or otherwise objectionable content –  we retain the right, but not the obligation, to reject, refuse to publish, or otherwise monitor all content displayed by users, and may remove or require users to remove all content.  Additionally, we retain the right to cancel the Media Lightbox account immediately and destroy the said content. 

Please Report abuse regarding any content that you believe might violate our terms.

Your Account

If you use Media Lightbox, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorized assess to your account. You agree to accept responsibility for all activities that occur under your account and password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, of if the password is being, or is likely to be, used in an unauthorized manner.

You are responsible for ensuring that your username is not misleading to other users and that it does not infringe the rights of others.

We reserve the right to refuse access to the Site, terminate accounts, remove or edit content, or cancel orders at our discretion.

Intellectual Property

You acknowledge and agree that all copyright, trademarks and all other intellectual rights in all materials and/or content made available as part of your use of this website remain at all times vested in us or our licensors.  You are permitted to use this material only as expressly authorised by us or our licensors. The website is made available for your personal non-commercial use only and you may download and print the content of the website for such purpose. Any other use of the website including, without limitation, linking to or framing the website without our prior written consent is strictly prohibited.

Copyright

We are not responsible for the storage or distribution of copyright protected files.  Any user found to be violating copyright laws will be terminated from using the Media Lightbox system.

Reserved Rights

• modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
• change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

Liability and Indemnity

We do not exclude or limit our liability or that of any other person for death or personal injury resulting from our or their negligence or for fraudulent misrepresentation.  Except as set out above and in relation to our contractual obligations to supply goods and/or services following acceptance of orders placed on our website, neither we nor any of our agents, affiliates, directors, employees or other representatives will be liable in contract, tort, negligence or otherwise for any loss or damage whatsoever in any way connected with your use of the website.

We shall not be liable for any indirect, or consequential loss of whatever nature, including damage to software or hardware, loss of data, damage for loss of business, loss of profits, or any other indirect or consequential loss arising out of or in connection with your use of the website (including without limitation, any such loss arising out of or in connection with any order placed on the website, whether or not accepted by us).

You agree to indemnify us and our agents, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you. We may terminate your use of the website immediately if we consider that you have breached these Terms and Conditions.

You hereby indemnify Us from and against all damages or losses suffered and/or costs or expenses incurred as a consequence of the contents of any comment posted by you giving liability to any third party whatsoever.

This indemnity shall extend to all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other professional costs and expenses) suffered or incurred by Media Lightbox or any of its Directors or Employees.

Media Lightbox gives no warranties or representations that the Site will be provided free of errors or defects.

The content on the website is provided without any representation. We expressly excludes all warranties, indemnities or terms, whether express of implied, to the fullest extent permitted by law including but not limited to, implied warranties of satisfactory quality, fitness for purpose, non-infringement, compatibility, accuracy, completeness, or security.

Media Lightbox accepts no liability in respect of direct, indirect, or consequential loss or damage incurred by any user of the site, any content contained on the site or links to third party webs

Adding Contacts : The Media Lightbox Policy

Our service allows the administrator or power user to import a list of email addresses in order to use the

Media Lightbox service. It is important to note that the email addresses that are imported to Media Lightbox

are only opt-in email addresses. An Opt-In email address is one in which the recipient of your emails has some

previous relationship with you or your business. This may be by acquiring their email address through a sales call,

a website form that they have filled in, via previous business exchanges, or through business or personal

friendship.

Forms of email addresses that are NOT appropriate are:

1.            Any non-specific email addresses (Examples of these are: postmaster@somedomain.com, webmaster@somedomain.com.

2.            Any purchased list of email addresses from any source no matter what that source claims.

3.            Any distribution lists or mailing lists, i.e. email addresses that mail to more than one email address

Importing names that violate these rules will make you subject to our Anti Spam Policy and may result in the

immediate termination of your account.
